Introduction
Just Cuts Franchising Pty Ltd and each of its independently owned franchisees ('Just Cut’s Franchisees”) (collectively referred to as “Just Cuts” we ","us " or"our ") are committed to respecting your personal information. Our privacy policy sets out how we collect, use, store and disclose your personal information. When you use our Websites, Apps, or provide your personal information to us, you consent to your personal information being collected, held, used and disclosed per this policy. We adopt and are bound by the Australian Privacy Principles (“APPs”) contained in Privacy Act 1988 (Cth) (“the Act”).
This Privacy Policy does not apply to other companies or organisations or websites to which Just Cuts is linked (including where we provide links to third party websites on our website or in our Apps) and we are not responsible for the privacy practices of any third parties.
This Privacy Policy covers Personal Information collected and used by Just Cuts in relation to any of the following:
- franchisees or prospective franchisees;
- clients;
- suppliers or prospective suppliers;
- independent contractors or any person who applies to become an employee or independent contractor; and
- Employees, including stylists employed by our franchisees.
For the purposes of this Privacy Policy, “Personal Information” is information or an opinion about you as an identified individual or an individual who is reasonably identifiable, whether or not the information or opinion is true and whether or not it is recorded in a material form.
What Personal Information We Collect and How We Collect It
- Just Cuts’ collects personal information about you in a number of ways, including:
- When you use our websites (including www.justcuts.com.au), social media pages, and internal websites or intranet (Website);
- When you email us or submit an enquiry via the contact us section of our website or any social media;
- When you apply for a job with us, or are employed or engaged by us;
- When you submit a franchisee enquiry, or interact with us as a franchisee;
- When you use our mobile and tablet apps, including the Just Cuts App (Apps) and to log-in to a Just Cuts salon; and
- When you interact with us and provide personal information by any other means, including either physically in our salons or electronically;
- From our franchisees;
- When you enter a promotion in our salon or on our website or via our social media;
- When you tag us on social media; and/ or
- When you are present at or outside our salons, including images, video and audio from CCTV, other cameras (including body cameras), and other security and recording systems; and/ or
- When you are a stylist engaged by one of our Franchisees, including when a stylist elects to use the Just Cuts Stylist App.
(collectively referred to as Collection Channels).
- The types of personal information we collect via the Collection Channels can vary depending on how you're involved with us — whether you're a client, a salon owner (franchisee), a supplier, an employee, or a contractor. In general, we may collect details like your name, address, phone number, email, age group, and your preferences or interests. If you register for or use our services, we might also collect things like your birthday, postcode, preferred salon location, booking or purchase history, interactions with our team, responses to marketing or feedback surveys, and payment details. If you're a salon owner, we may also collect business-related information such as your company ABN or ACN, bank and credit card details, profit and loss statements, balance sheets, weekly revenue and sales figures, and other business data that may include personal information. If you're employed by us, working with us as a contractor, or applying for a role, we may collect additional information like your job title, start date, employment status, location, gender, bank details, emergency contact info, qualifications, previous jobs, driver’s licence, car rego, leave records, salary or wages, date of birth, superannuation details, tax file number, visa or immigration info (if relevant), and records related to your performance or conduct. We may also collect sensitive information such as health or medical details. If you apply for a job or contract, we may also contact your referees to collect further personal information. From time to time, we may take photos or videos for marketing or promotional use. These may include images of salons, salon owners, staff, or clients that could identify individuals. If you're an employee, we may also use your photo internally for identification purposes. If you interact with us on social media, we may collect other information about you (like photos, videos, and posts) depending on your privacy settings; if you tag us, we may reshare the tagged content. This can come from our own social pages or from sites linked to them. You're not required to give us your personal information, and in some cases you can choose to remain anonymous or use a nickname. However, depending on your relationship with us, we may not be able to provide our services to you if we don’t have the necessary information.
- The type of information we collect may include:
- name;
- contact details including email address and telephone number;
- location information - you permit an App to access location services in your settings, then we collect your device location to deliver your order or to send you alerts;
- date of birth;
- demographic information such as postcode;
- preferences and opinions;
- device information - such as the hardware model, operating system, preferred language, unique device identifier and mobile network;
- when you’re applying for a job with us, your job history, referee and location information, as well as visa or immigration status information (where applicable); ;
- where you are applying to a franchisee, financial information and references; and
- any other information requested on the Just Cuts Website, the Just Cuts App, in-salon or otherwise requested by us or provided by you.
Your Use of our Website and Apps
- Your use of the Just Cuts Website: As with most businesses, we may log information about your access and use of the Just Cuts Website, including through the use of Internet cookies, your communications with the Just Cuts Website, the type of browser you are using, the type of operating system you are using and the domain name of your Internet service provider.
- Your opinion and feedback: We may contact you to voluntarily respond to questionnaires, surveys or market research to seek your opinion and feedback. Providing this information is optional to you.
- If we receive your personal information from third parties, we will protect it as set out in this Privacy Policy.
Why We Collect Personal Information, and How We Use It
- Collection and use of personal information We collect and use the information for purposes including:
- supplying our services to you;
- to contact and communicate with you including via SMS and other electronic methods;
- for internal record keeping;
- for the purposes stated on a particular Collection Channel or Privacy Collection Statement;
- to maintain and improve the functionality of a Website or App;
- to fulfil obligations in respect of any sale and purchase contract and/or any other contract between you and Just Cuts;
- to alert you when we are available to provide services;
- to provide you with information about your transactions and loyalty entitlements;
- to provide marketing materials and information about our products and services, events, special offers, competitions and/or promotions, or to request your feedback for promotional purposes;
- to respond to client enquiries or complaints;
- to manage your employment or process your application for employment with Just Cuts (including Just Cuts franchisees), to provide employee assistance programs and facilitate effective employment practices;
- to obtain opinions or comments about products and/or services and to conduct other market research and development (including to record statistical data for marketing analysis);
- in the case of images and video/audio from our security and recording systems used in and around our salons, for security, safety, compliance, and operational purposes;
- to send you any technical, administrative or legal notices important to our Websites and Apps;
- planning, product development or research purposes;
- enforcing the terms and conditions of our engagement with you;
- ensuring compliance with statutory obligations;
- for market research and business development including website development;
- for marketing including direct marketing conducted by us, by a Just Cuts Salon or by a 3rd party;
- to run competitions or offer additional benefits to you;
- to send you promotional information about us or third parties that we think may be of interest to you;
- for data analytics purposes conducted by us, by a Just Cuts Salon or by a 3rd party;
- in relation to the personal information of franchisees or prospective franchisees, we may use it for the purposes mentioned above, as well as to conduct credit checks, verify information required under the franchise agreement (including by contacting suppliers, trade referees, insurers, banks, councils or other relevant parties), confirm and enforce compliance with the franchise agreement, provide franchisee support, meet our disclosure obligations under the Franchising Code of Conduct, and carry out all functions related or incidental to our role as a franchisor; and
- we may also use and disclose personal information about you in connection with your employment, in accordance with applicable laws.
- Just Cuts Franchisee application/expression of interest - When you apply to become a franchisee, or submit an expression of interest, we will collect information from you, including sensitive information, for the purposes of assessing your suitability (to which you have consented). When you apply to be a Just Cuts Franchisee, we (or our franchisee as the case may be) may collect the following details from you (including but not limited to):
- Full name;
- Mobile Phone;
- Email Address;
- Address/Location;
- Financial Position;
- Reason of interest
- You acknowledge that consent has been provided for us to collect and use your personal information for the purpose of:
- assessing your suitability as a Just Cuts franchisee at the time of making your application/submitting your expression of interest; and/or
- sending you information about future franchising opportunities.
Disclosure to Third Parties
- Disclosure of personal information to third parties - We may disclose personal information to:
- a Just Cuts Salon/ our franchisee/s including potential franchisees of a Just Cuts Salon;
- our Associated Entities;
- the general public, for example, via internet when notifying of competition results or via media when photographs or video are used in advertising material or campaigns;
- credit reporting agencies and courts, tribunals and regulatory authorities where clients fail to pay for goods or services provided by us to them;
- courts, tribunals, regulatory authorities and law enforcement officers as required by law, in connection with any actual or prospective legal proceedings, or in order to establish, exercise or defend our legal rights;
- third parties, including agents or sub-contractors, who assist us in providing information, products, services or direct marketing to you. This may include parties located, or that store data, outside of Australia; and
- third parties to collect and process data including Google Analytics. This may include parties that store data outside of Australia.
- If you are a franchisee, in addition to the uses and disclosures mentioned above, you consent to us using and disclosing your personal information in the following ways:
- allowing some of your financial information to be used for analytical purposes;
- making certain personal information—such as names, contact details, and photos of employees—accessible to other franchisees and employees through the intranet or other digital systems;
- sharing your contact details with landlords and certain suppliers so they can contact you directly;
- providing your personal information to our legal and professional advisors for the purpose of preparing franchising documents or obtaining legal or other professional advice; and
- preparing and issuing the Franchise Disclosure Document in accordance with the Franchising Code.
- By engaging with our social media pages, you agree to the terms and privacy policies of those platforms, which operate independently of us. Content such as photos or posts you share may be publicly visible, re-shared by others, and remain accessible online indefinitely. While you may be able to delete content from the original location you posted it, anything re-shared by others is beyond our control and may not be able to be removed by you or us. We are not responsible for how that content is used or shared by others. We also reserve the right to remove any content from our social media pages that we consider inappropriate or offensive.
- When we disclose your personal information to third parties for these purposes, we will request that the third party follow this Privacy Policy regarding handling of your personal information.
- If there is a change of control of our business or a sale or transfer of business assets, we reserve the right to transfer to the extent permissible by law our user databases, together with any personal information and non-personal information contained in those databases. This information may be disclosed to a potential purchaser. We would seek to only disclose information in good faith.
Your Rights
- Your rights and controlling your personal information
- Choice and consent: Providing us with your personal information is optional to you. You can choose not to provide personal information. When you provide us with your personal information, you consent to the terms in this Privacy Policy, and to us disclosing or receiving your personal information for these purposes. Just Cuts will only collect or monitor any personal information about you as provided in this privacy policy.
- Your provision of third party information: If you provide us with third party personal information then you warrant to us that you have the third party’s consent to provide this.
- Restrict: You may choose to restrict the collection or use of your personal information. If you have previously agreed to us using your personal information for direct marketing purposes, you may change your mind at any time by contacting us at the email address listed in this Privacy Policy or unsubscribing as directed.
- Access: You may request details of personal information that we hold about you, in certain circumstances set out in the Privacy Act 1988 (Cth) (Privacy Act). An administrative fee may be payable for the provision of information. We may refuse to provide you with information that we hold about you, in certain circumstances set out in the Privacy Act.
- Correction: If you believe that any information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, please contact us by email. We rely in part upon clients, franchisees and employees advising us when their personal information changes. We will respond to any request within a reasonable time. We will endeavour to promptly correct any information found to be inaccurate, incomplete or out of date.
- Complaints: If you believe that we have breached the Australian Privacy Principles and wish to make a complaint about that breach, please contact us by email setting out details of the breach. We will promptly investigate your complaint and respond to you in writing setting out the outcome of our investigation, what steps we propose to take to remedy the breach and any other action we will take to deal with your complaint.
- Unsubscribe: To unsubscribe from our e-mail database, internal database, or opt out of communications, please contact us using the details below or follow the relevant unsubscribe functionality included on the relevant communication, which shall be contained in all marketing and promotion communications.
Storage & Security
- We may disclose your Personal Information to recipients located outside of Australia, who are likely to be located in South East Asia, Canada, New Zealand or the United Kingdom.
- You should be aware that some social media Sites used by us or programs, software or online tools you may use to access our website or social media Sites, are based in and/or housed overseas. Whilst we do not actively disclose your Personal Information to such organisations, the use of such programs by us may involve disclosure of your Personal Information. Use and disclosure of your Personal Information by such organisations is in accordance with the terms and conditions and privacy policies of such organisations.
- We are committed to ensuring that the information you provide is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure. This includes:
- ensuring the physical security of our premises and databases/records;
- taking measures to restrict access to personnel who need that information in order for us to be able to provide our products and services; and
- technological measures, such as computer passwords, data back-up, data encryption, anti-virus software and firewalls.
- No information transmitted over the Internet can be guaranteed to be secure. We cannot guarantee the security of any information that you transmit to us, or receive from us. The transmission and exchange of information is carried out at your own risk. To the extent permitted by law, you release us from any and all liability arising from any security breach or similar.
- All Just Cuts’ employees and service providers are obliged to respect the confidentiality and security of any personal information held by Just Cuts. Although we take measures to safeguard against unauthorised disclosures of information, we cannot assure you that personal information that we collect will not be disclosed in a manner that is inconsistent with this Privacy Policy.
- Your personal information may be stored in different locations depending upon the reason for which you originally submitted the information. If you make an inquiry in relation to your personal information, the more information you can provide us about when you originally provided your personal information, the quicker Just Cuts will be able to retrieve your personal information. Just Cuts may require you to verify your identity by asking you to provide certain information about yourself and provide us with a declaration witnessed and signed by a Justice of Peace. Once your identity is verified, we will work to provide you with your requested information.
- If you request, we will take all reasonable steps to delete your personal information, except where it is required for legal and compliance purposes. Deletion of information may result in Just Cuts being unable to facilitate or provide you with information about certain transactions, other content, services or product information, upcoming promotions, event information, and/or provide certain content, products or services.
- We are not responsible for removing your personal information from the lists of any third party who has previously been provided your information in accordance with this privacy policy.
Cookies & Web Beacons
- We may use cookies on the Just Cuts Website from time to time. Cookies are text files placed in your computer's browser to store your preferences. Cookies, by themselves, do not tell us your e-mail address or other personally identifiable information. However, once you choose to furnish the Just Cuts Website with personally identifiable information, this information may be linked to the data stored in the cookie.
- We may use web beacons on the Just Cuts Website from time to time. Web beacons or clear .gifs are small pieces of code placed on a web page to monitor the visitors’ behaviour and collect data about the visitors viewing a web page. For example, web beacons can be used to count the users who visit a web page or to deliver a cookie to the browser of a visitor viewing that page.
- We may use Google Analytics to collect and process data. To find out how Google uses data when you use third party websites or applications, please see www.google.com/policies/privacy/partners/ or any other URL Google may use from time to time.
- By accessing a Website or App via links and/or linked accessing a Website or App where you have identified yourself, you consent to the collection of this information.
Links to other websites
- Our Just Cuts Website may contain links to other websites of interest. We do not have any control over those websites. We are not responsible for or liable for the protection and privacy of any information which you provide whilst visiting such websites, and such websites are not governed by this Privacy Policy.
- All Websites and Apps operated by Just Cuts in Australia will adhere to this privacy policy. The policies on the Websites and Apps of some other members of the Just Cuts corporate group may vary because of local customs, practices or laws.
Not providing information
- You do not have to provide any personal information to use. However, if you do not do so, this may affect or completely restrict your ability to use our products and services, including our Websites or App, our ability to provide you with relevant content, prizes, products and services, or our ability to process your queries and employment and/ or franchise applications.
Sharing your personal information
- Just Cuts shares personal information with our associated entities and our service providers for the purposes described in this privacy policy. Just Cuts recognises the trust with which you provide personal information, and except as stated in this privacy policy or any particular Privacy Collection Statement, your information will not be used or disclosed for any other purpose without your consent. However, Just Cuts reserves the right to use or disclose any information, including personal information, as needed to satisfy any law, regulation or legal request, to protect the rights or property of Just Cuts, any member of the Just Cuts’ corporate group, or any member of the public, to protect the integrity of a Website, to fulfil your requests, or to cooperate in any law enforcement investigation or an investigation on a matter of public safety. In some cases, Just Cuts may disclose your personal information to overseas recipients, including but not limited to recipients in the United Kingdom, New Zealand and Canada, being countries in which Just Cuts operates.
Ability of others to view information
- Just Cuts provides areas on Websites, Apps and various social media platforms where you can upload user-generated content, post or provide information about yourself, communicate with other users, provide reviews for content, products and/or services or interact with or vote on particular content. This information may be publicly posted on a Website, App or social media platforms and/or shared with others, including social media platforms and other public forums in which you choose to participate. This information may become publicly available and may be read, collected and used by others outside of a Just Cuts Website or App. Just Cuts is not responsible for the conduct of others who may read, collect and use this information.
Children
- Just Cuts is sensitive to privacy issues and is proud of our commitment to our clients. Just Cuts does not intend to collect personal information from any person under the age of 18 years without the consent of a parent or legal guardian. We urge parents to regularly monitor and supervise their children’s online activities. We will take reasonable steps to ensure we only post images of minors with the express consent of their legal guardian (when the minor is the primary subject matter of the image) and/ or we will notify persons in group settings (for example, salon openings) when images may be recorded for intended publication, so as to enable parents and guardians to make an informed decision.
Franchisee privacy policies
- Most Just Cuts salons are owned and operated by independent franchisees. Just Cuts does not control the use or disclosure of personal information and may not have access to the personal information held by Just Cuts franchisees. Just Cuts franchisees are each responsible for ensuring that your personal information collected by them is handled in accordance with this Privacy Policy and the Australian Privacy Principles. If you are concerned that there may have been a breach of this privacy policy by a franchisee, please contact us directly.
General
- This Privacy Policy may be amended, including with changes, additions and deletions, from time to time in our sole discretion. Your continued use of the Just Cuts Website following any amendments indicates that you accept the amendments. You should check this Privacy Policy regularly, prior to providing personal information, to ensure you are aware of any changes, and only proceed to provide personal information if you accept the new Privacy Policy. You can determine when this Privacy Policy was last revised by referring to the date it was “Last Updated” below.
- Platform Permissions - Mobile platforms such as iOS and Android may define certain types of information or data that our Apps cannot access without your consent. Each platform has its own permissions system for obtaining your consent. For example, the iOS platform may alert you the first time an App wants your permission to access certain types of data (e.g. location services) and will provide you the option to consent to that request. Android devices may notify you of the permissions that an App seeks before you first use the App and your subsequent use of the App constitutes your consent.
